1. Interpretation & Definitions
1.1 Interpretation
Words with an initial capital letter have meanings defined below. These definitions apply whether the word appears in singular or plural form.
1.2 Definitions
- "Company", "We", "Us", "Our"
- WinQuest Online, operated by Winquest Advisory Services LLP, registered in India, with offices in Kolkata, West Bengal, India.
- "Platform" / "Website"
- The website available at winquestonline.com and any associated mobile applications or sub-domains.
- "Services"
- All educational services offered through the Platform, including but not limited to one-to-one live tutoring, group classes, pre-recorded video courses, free trial sessions, and free workshops.
- "User", "You", "Your"
- Any individual who accesses or uses the Platform, including students, parents, guardians, and independent visitors.
- "Student"
- A User who enrols in, or purchases, any Service on the Platform.
- "Tutor" / "Instructor"
- A qualified educator or subject-matter expert who delivers Services through the Platform.
- "Content"
- All text, images, videos, audio, lesson plans, assessments, worksheets, and any other materials created or shared through the Platform.
- "Session"
- A scheduled live or recorded teaching interaction between a Tutor and one or more Students.
- "Subscription"
- A recurring payment plan that grants ongoing access to selected Services.
- "GDPR"
- The EU General Data Protection Regulation 2016/679 and its UK equivalent (UK GDPR).
- "DPDP Act"
- The Digital Personal Data Protection Act, 2023 (India).
2. Acknowledgment
By accessing or using the Platform you confirm that:
- You have read, understood, and agree to these Terms of Service and our Privacy Policy.
- You are at least 18 years old, or you are a parent or legal guardian acting on behalf of a minor student and you accept these Terms on their behalf.
- You have the legal capacity to enter into a binding agreement in your jurisdiction.
- Your use of the Platform does not violate any applicable law or regulation.
If you do not agree with any part of these Terms, you must not use the Platform or purchase any Services.
3. Eligibility & User Accounts
3.1 Age Requirements
The Platform is designed to serve learners of all ages, including children. Students under 13 (US) or under 16 (EU/UK) may only enrol with verifiable parental or guardian consent. We comply with COPPA (US), GDPR Article 8 (EU/UK), and the DPDP Act (India) with respect to the personal data of minors.
3.2 Account Registration
To purchase Services or access member-only features you must create an account. When registering you agree to:
- Provide accurate, complete, and current information.
- Keep your login credentials confidential.
- Notify us immediately at contact@winquestonline.com if you suspect unauthorised access to your account.
- Accept responsibility for all activity that occurs under your account.
3.3 One Account per User
Each individual may hold only one student account. Creating multiple accounts to circumvent policies (including refund or trial policies) is prohibited and may result in permanent account suspension.
4. Scope of Services
4.1 Service Categories
WinQuest Online offers the following categories of educational services:
- One-to-One Live Tutoring — Personalised sessions with a dedicated Tutor via Zoom or Google Meet.
- Group Classes — Small-group live sessions (typically 2–8 students) at a reduced per-student rate.
- Pre-Recorded Video Courses — Self-paced video lessons accessible on demand after purchase.
- Free Trial Classes — A complimentary introductory session (up to 60 minutes) available once per new student.
- Free Workshops — Periodic group events open to all registered users.
4.2 Subject Areas
Our Tutors cover a wide range of subjects including Mathematics, Sciences (Physics, Chemistry, Biology), English Language & Literature, Coding (Python, Java, Scratch, Robotics), Competitive Exam preparation (JEE, NEET, SAT, ACT, AP courses), Olympiad training, Music (Violin, Keyboard), and AI & Machine Learning.
4.3 Curriculum Alignment
Sessions can be aligned to major curricula including CBSE, ICSE, IB (MYP/DP), IGCSE, AP (College Board), and the US Common Core standards.
4.4 Session Delivery
Live sessions are conducted via video-conferencing software (currently Zoom or Google Meet). You are responsible for maintaining a stable internet connection and compatible device. WinQuest Online is not liable for sessions disrupted by your connectivity issues.
4.5 Scheduling & Rescheduling
Sessions must be booked at least 24 hours in advance through the Platform or by contacting our support team. Cancellations or reschedules with less than 24 hours' notice may be counted as a completed session. Repeated late cancellations may result in account review.
4.6 Session Recordings
We may record live sessions for quality assurance, safeguarding, and student review purposes. Recordings are stored securely and shared only with the enrolled student(s) and their parent/guardian. You consent to recording by attending a live session. You may opt out by notifying your Tutor at the session start, though this may limit post-session support.
5. Payment & Refund Policy
5.1 Pricing
All prices are displayed on the Platform at the time of purchase. Our indicative rates are:
- Academic subjects (Maths, Science, English, Competitive Exams): ₹750 / hour
- Coding & Technology (Python, Java, Scratch, Robotics, AI & ML): ₹600–₹1,200 / hour
- Music & Arts (Violin, Keyboard): ₹600–₹1,000 / hour
Prices for international students may be displayed in USD or GBP. We reserve the right to revise prices with 14 days' notice to existing subscribers.
5.2 Payment Terms
Payment is accepted in advance, typically on a monthly basis for recurring tutoring packages. Payment methods include credit/debit cards, UPI, net banking (via Razorpay for Indian customers), and international card payments. By providing payment details you authorise us to charge the agreed amount.
5.3 Free Trial
Each new student is entitled to one free trial session of up to 60 minutes. The trial is non-transferable and cannot be redeemed more than once per household. No payment information is required to book a free trial.
5.4 Cooling-Off Period (EU / UK Students)
If you are resident in the European Union or the United Kingdom, you have the right to withdraw from a purchase within 14 days of placing your order without giving any reason, provided that the Services have not yet commenced. If you request that Services begin within the 14-day period, you acknowledge that you lose this right upon commencement, and a pro-rated charge will apply for sessions already delivered.
5.5 Refund Policy
Outside the EU/UK cooling-off period, the following refund rules apply:
- Pre-paid sessions not yet used: Refundable in full, upon written request to contact@winquestonline.com.
- Sessions cancelled by the Tutor: Automatically credited to your account or refunded within 7–10 business days.
- Sessions cancelled by the Student with < 24 hours' notice: Non-refundable.
- Technical issues on our end: Session rescheduled at no cost or credited to your account.
- Pre-recorded video courses: Refundable within 7 days of purchase if fewer than 20% of the course content has been accessed.
Approved refunds are processed within 7–10 business days to the original payment method.
5.6 Taxes
Prices may be subject to applicable taxes (including GST for Indian customers). The applicable tax will be displayed at checkout. You are responsible for any additional taxes, duties, or levies imposed by your jurisdiction.
6. Acceptable Use
6.1 Permitted Use
You may use the Platform solely for lawful, personal, non-commercial educational purposes consistent with these Terms.
6.2 Prohibited Conduct
You must not:
- Record, download, redistribute, or resell any live session, video course, or Content without our prior written consent.
- Share your account credentials with third parties or allow others to access the Platform through your account.
- Use the Platform to harass, bully, defame, or threaten Tutors, staff, or other students.
- Upload, transmit, or distribute any content that is unlawful, obscene, hateful, discriminatory, or that infringes third-party intellectual property rights.
- Attempt to reverse-engineer, scrape, or otherwise misuse the Platform's systems or data.
- Use automated tools (bots, scripts) to interact with the Platform without our written authorisation.
- Impersonate any person, including Tutors, staff, or other students.
- Use the Platform for academic dishonesty, including cheating in exams or submitting work completed by a Tutor as your own without disclosure.
6.3 Consequences of Misuse
Violation of these acceptable-use rules may result in immediate suspension or permanent termination of your account, forfeiture of any unused prepaid sessions (without refund), and/or legal action.
7. Intellectual Property
7.1 Our Content
All Content on the Platform — including lesson materials, worksheets, videos, software, trade marks, logos, and the overall look and feel of the Platform — is owned by or licensed to WinQuest Online and is protected by copyright, trade mark, and other intellectual property laws.
7.2 Limited Licence to Users
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use Content solely for your personal educational purposes. This licence does not permit you to copy, reproduce, distribute, publicly display, create derivative works from, or commercially exploit any Content.
7.3 User-Submitted Content
If you submit any content to the Platform (e.g., reviews, forum posts, or uploaded assignments), you grant us a worldwide, royalty-free licence to use, reproduce, modify, and display that content in connection with our Services. You retain ownership of your content and represent that you have the right to grant this licence.
7.4 Feedback
Any feedback, suggestions, or ideas you submit regarding the Platform may be used by us without restriction or compensation to you.
7.5 DMCA / Copyright Takedown
If you believe that Content on the Platform infringes your copyright, please send a written notice to legal@winquestonline.com with sufficient details to identify the allegedly infringing material and your ownership of the original work.
8. Data Protection & Privacy
Your privacy matters to us. The collection, use, and storage of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
We comply with applicable data-protection laws including:
- GDPR / UK GDPR — for users in the EU and UK.
- COPPA — for children under 13 in the United States.
- PIPEDA / CPPA — for users in Canada.
- PDPA — for users in Singapore and Thailand.
- DPDP Act 2023 — for users in India.
- CCPA / CPRA — for residents of California, USA.
By using the Platform you consent to the data practices described in our Privacy Policy. Parental consent is required before we collect personal data from children under applicable age thresholds in your jurisdiction.
9. Third-Party Tools & Links
9.1 Third-Party Services
The Platform integrates with third-party services to deliver its functionality, including but not limited to:
- Zoom / Google Meet — live session delivery.
- Razorpay — payment processing for Indian customers.
- Stripe — payment processing for international customers.
- Google Analytics & Meta Pixel — analytics and advertising.
- WhatsApp Business — customer communications.
- YouTube — embedded video content.
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party providers.
9.2 External Links
The Platform may contain links to external websites. These links are provided for convenience only. We do not endorse, control, or take responsibility for the content of any linked sites. Accessing external links is entirely at your own risk.
10. Disclaimers
10.1 Educational Outcomes
We do not guarantee any specific academic results, grade improvements, examination pass rates, or other educational outcomes. Success depends on many factors including the student's effort, prior knowledge, and external circumstances beyond our control.
10.2 Platform Availability
We strive for high availability but do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. Scheduled maintenance windows will be communicated in advance where possible.
10.3 Tutor Credentials
We vet all Tutors before onboarding, including qualification verification and background checks. However, we do not warrant that any Tutor's credentials, skills, or teaching style will meet your personal expectations. We encourage you to use the free trial session to assess compatibility.
10.4 "As Is" Basis
To the maximum extent permitted by applicable law, the Platform and all Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Limitation of Liability
11.1 Exclusion of Indirect Losses
To the fullest extent permitted by law, WinQuest Online shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform or Services, including but not limited to loss of profits, loss of data, loss of goodwill, or any other intangible losses.
11.2 Aggregate Cap
Our total aggregate liability to you for any claims arising from or related to these Terms or the Services shall not exceed the greater of: (a) the total amount you paid to us in the six months preceding the event giving rise to the claim, or (b) USD $100 (or equivalent in INR at the prevailing exchange rate).
11.3 Statutory Rights
Nothing in these Terms limits or excludes any liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
11.4 Consumer Protection
If you are a consumer in the EU, UK, or Australia, you may have statutory rights that these Terms cannot override. Nothing here is intended to affect those rights.
12. Termination
12.1 Termination by You
You may close your account at any time by contacting us at contact@winquestonline.com. Any unused prepaid sessions will be refunded in accordance with Section 5.5.
12.2 Termination by Us
We reserve the right to suspend or terminate your account, with immediate effect, if you:
- Breach any provision of these Terms.
- Engage in abusive, threatening, or discriminatory behaviour toward Tutors or staff.
- Provide false registration information.
- Fail to make payment for Services.
- Otherwise act in a manner inconsistent with the safety and integrity of the Platform.
12.3 Effect of Termination
Upon termination, your right to access the Platform ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law shall survive termination.
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including acts of God, pandemic, governmental action, civil unrest, power outages, internet infrastructure failures, or other events of force majeure. In such cases we will make reasonable efforts to reschedule affected sessions or provide credits.
14. Governing Law & Disputes
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of India. For users in the EU/UK, mandatory consumer protection laws of your country of residence also apply alongside Indian law.
14.2 Dispute Resolution
We encourage you to contact us first to resolve any disputes informally. If we cannot reach a resolution within 30 days, disputes shall be referred to the courts of Kolkata, West Bengal, India, which shall have exclusive jurisdiction, subject to any mandatory local consumer-protection jurisdiction that cannot be waived.
14.3 EU/UK Online Dispute Resolution
If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
15. Updates to These Terms
We may revise these Terms at any time. When we do, we will:
- Update the "Last updated" date at the top of this page.
- Send an email notification to registered users for material changes.
- Where required by law, obtain renewed consent before the changes take effect.
Your continued use of the Platform after any update constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and may request a refund for any unused prepaid sessions.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy and any course-specific terms presented at checkout, constitute the entire agreement between you and WinQuest Online with respect to the Services and supersede all prior agreements.
16.2 Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of future enforcement of that right or provision.
16.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights to any affiliate, successor, or acquirer without restriction.
16.5 Language
These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
